French Constitutional Council Protects Mission-Driven Institutions in Landmark Assisted-Dying Decision

On 14 August 2026, The French Constitutional Council has ruled on the law on euthanasia (décision n° 2026-910 DC). While upholding the law, the Court argued in paragraph 188 that private institutions may refuse to permit an assisted-dying procedure on its premises where it is contrary to their statutory mission. The Council's reservation concerning the protection of institutional missions reflects a central concern of our contribution!

Our contribution extérieure submitted to the French Conseil constitutionnel

On 26 July 2026, Centre for Law and Religious Freedom at Jagiellonian University and the Religious Freedom Clinic at Harvard Law School submitted "contribution extérieure" to the French Conseil constitutionnel as part of a priori review of recently-enacted euthanasia law initiated by the referral of the President of French Senate on Thursday, July 16 pursuant to Article 61 of the Constitution of France. Both centres submit this contribution to assist the Council by providing international law and comparative perspectives on collective religious exercise and the autonomy of religious communities and institutions.

Written comments submitted to the European Court of Human Rights

On 9 June 2026, Centre for Law and Religious Freedom at the Department of Roman Law at Jagiellonian University and the Religious Freedom Clinic at Harvard Law School intervened as a third party before the European Court of Human Rights in the case Pontificia, Real y Venerable Esclavitud del Santísimo Cristo de la Laguna and Diocese of San Cristóbal de la Laguna v. Spain (Application no. 7421/25). This constitutes our direct submission of written comments to the Strasbourg Court.

Malibu Conference: The State of Religious Freedom 2026

"The State of Religious Freedom" conference was held on June 7-9, 2026 at Pepperdine University’s campus in Malibu, California, by the Pepperdine University Caruso School of Law’s Ken Starr Institute for Faith, Law, and Public Service; the Nootbaar Institute; and in the partnership with the Centre for Law and Religious Freedom at Jagiellonian University.

Kraków Conference: State Regulation and Religious Freedom

The Centre for Law and Religious Freedom at the Department of Roman Law at Jagiellonian University, in collaboration with the Religious Freedom Clinic at Harvard Law School and the International Center for Law and Religion Studies at Brigham Young University, organized a conference on "State Regulation and Religious Freedom". The event took place in the Aula of the Collegium Novum at Jagiellonian University in Kraków. It brought together 24 speakers, including judges, practitioners, and scholars from 12 countries, over 20 invited guests from 7 countries, and representatives of the public—a total of approximately 130 conference participants who gathered to engage in constructive discussions on the state of religious freedom around the world.
